1. Overview

This online store is operated by NM9 Performance LLC ("NM9 Performance," "we," "us," "our"). By visiting this store or buying anything from us, you agree to these Terms of Service ("Terms"), along with our Return and Refund Policy, Shipping Policy and Privacy Policy, which are part of these Terms. If you do not agree, please do not use the store.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are under 18, a parent or legal guardian must place the order and agrees to these Terms for you.

3. Products

All products are printed to order. We do our best to show colors, graphics and placement accurately, but screens vary and print-to-order garments can differ slightly from product images in color, print placement and size. Sizing is approximate; please use the size chart on each product page. We may change, limit or discontinue any product at any time.

4. Pricing and payment

Prices are in U.S. dollars and may change without notice. We may correct pricing or listing errors, and may cancel any order placed at an incorrect price, with a full refund. You agree to provide current, complete and accurate billing and shipping information. Payments are processed by Shopify and its payment partners; we do not store your full card details.

5. Orders

We may refuse, limit or cancel any order, including orders that appear to be placed by resellers, distributors, or that we suspect are fraudulent. If we cancel an order after you have been charged, we will refund the charge.

6. Returns, refunds and shipping

All sales are final. Replacements for damaged, defective or misprinted items are handled under our Return and Refund Policy. Shipping is handled under our Shipping Policy. Title and risk of loss pass to you when the order is handed to the carrier.

7. Intellectual property

All content on this store, including the NM9, NM9 Performance, Not By Sight, God's Plan and Faith Over Fame names and logos, designs, graphics, artwork, photos and text, is owned by or licensed to NM9 Performance LLC and is protected by copyright, trademark and other laws. Buying a product does not give you any right to copy, reproduce, resell as your own design, or commercially use our designs or marks. You may not use our content without our prior written permission.

8. Prohibited uses

You may not use this store for any unlawful purpose; to infringe our rights or anyone else's; to upload viruses or harmful code; to scrape, copy or harvest content or data; to interfere with the store's security or operation; or to impersonate any person.

9. Comments and feedback

If you send us ideas, suggestions, reviews or other feedback, we may use them without restriction or compensation to you. You are responsible for any comments you submit, and you agree they will not be unlawful, abusive or infringing.

10. Third-party services

This store uses third-party services (such as Shopify, payment processors, our production partners and shipping carriers). We are not responsible for their acts, content or policies.

11. Disclaimer of warranties

The store and all products are provided "as is" and "as available." To the fullest extent allowed by law, NM9 Performance disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Our only obligation for a damaged, defective or misprinted product is the remedy described in our Return and Refund Policy.

12. Limitation of liability

To the fullest extent allowed by law, NM9 Performance LLC and its owners, members, employees, partners and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the store or any product. Our total liability for any claim will not exceed the amount you paid for the product that gave rise to the claim.

13. Indemnification

You agree to defend, indemnify and hold harmless NM9 Performance LLC and its owners, members, employees and partners from any claims, losses, damages and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your violation of any law or the rights of a third party.

14. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Pierce County, Washington, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us at support@nm9performance.com and try to resolve it informally for at least 30 days.

15. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and the policies referenced in them are the entire agreement between you and NM9 Performance for use of the store. Our failure to enforce any part of these Terms is not a waiver.

16. Changes

We may update these Terms at any time by posting the new version on this page. Your continued use of the store after changes are posted means you accept them.
